								<content:encoded><![CDATA[<p><strong>FRACKING REGULATIONS SET ASIDE BY EASTERN CAPE HIGH COURT</strong></p>
<p><strong>&nbsp;</strong></p>
<p>Government’s intention to proceed with a shale gas industry through hydraulic fracturing (commonly known as fracking) was dealt a significant blow on Tuesday, 17 October 2017, when the Eastern Cape High Court retrospectively set aside the 2015 decision by the Minister of Mineral Resources&nbsp;to enact Regulations for Petroleum Exploration and Production (commonly known as the Fracking Regulations).&nbsp; The Fracking Regulations, which have been in place since June 2015, were regarded as a vital statutory requirement for the granting of shale gas exploration and production rights in South Africa.</p>
<p>&nbsp;</p>
<p>The application for the review and setting aside of the Fracking Regulations was brought by the President of Agri Eastern Cape, Douglas Stern, together with 15 other applicants, including the Graaff-Reinet, Cradock, Jansenville and Buffelshoek Agricultural unions.</p>
<p>&nbsp;</p>
<p>In reaching his decision, Judge GH Bloem accepted the undisputed major possible impacts of fracking and shale gas development with respect to air, soil and groundwater contamination due to uncontrolled gas or fluid flows arising from blow-outs or spills, interception of naturally occurring fractures and fissures, well failures, corrosion of casings, cementing failure, leaking fracturing fluid and uncontrolled waste water discharge.</p>
<p>&nbsp;</p>
<p>Advocates for the applicants argued that the Minister of Mineral Resources was not authorised to make the Fracking Regulations, that it contravened the provisions of the National Environmental Management Act and the National Water Act and that their making was procedurally unfair.&nbsp; The Court agreed.&nbsp; It also made an adverse costs order against the Minister of Mineral Resources.</p>
<p>&nbsp;</p>
<p>The Court further took issue with the Minister of Mineral Resources’ enactment of the Fracking Regulations which unilaterally amended an agreement with the Minister of Environmental Affairs and Minster of Water Affairs in terms of which the regulation of the environmental impacts of mining have since September 2014 fully been regulated in terms of the National Environmental Management Act.</p>
<p>&nbsp;</p>
<p>In commenting on the judgement, Douglas Stern commended the efforts of the Eastern Cape agricultural community in persevering with their continued opposition to fracking in that province.</p>

<p><strong>Skaliegas regulasies deur Oos-Kaapse Hooggeregshof ter syde gestel</strong></p>

<p>Die regering se planne om met ‘n skaliegas industrie by wyse van hidrouliese breking voort te gaan het Dinsdag, 17 Oktober 2017, ‘n ernstige terugslag ervaar toe die Oos-Kaapse Hooggeregshof die besluit wat in 2015 deur die Minister van Mineraalhulpbronne geneem is om die Petroleum Eksplorasie en Produksie Regulasies (algemeen bekend as die Hidrobreking Regulasies) te promulgeer retrospektief ter syde te stel.&nbsp; Die Hidrobreking Regulasies, wat sedert Junie 2015 van krag is, is as ‘n kritiese voorvereiste beskou vir die toekenning van skaliegas eksplorasie en produksie regte in Suid Afrika.</p>
<p>&nbsp;</p>
<p>Die aansoek om die tersydestelling van die Hidrobreking Regulasies is deur die President van Agri Oos-Kaap, Douglas Stern, tesame met 15 ander applikante, insluitende die Graaf-Reinet, Cradock, Jansenville en Buffelshoek Landbou Unies, aanhangig gemaak.</p>
<p>&nbsp;</p>
<p>In sy beslissing het Regter GH Bloem die onmiskenbare ernstige moontlike omgewingsimpakte van hidrobreking en skaliegas ontwikkeling aanvaar wat betref lug, grond en waterbesoedeling as gevolg van onbeheerbare gas- of vloeistof vrystellings vanweë sogenaamde uitblasings of stortings, die inbreking op natuurlike krake en barste in die aardkors, boorgat disintegrering, die roes van boorgat omhulsels, beton disintegrering, lekkasie van hidrouliese breking vloeistowwe en onbeheerbare afvalwater vrystellings.</p>
<p>&nbsp;</p>
<p>Advokate namens die applikante het geargumenteer dat die Minister van Mineraalhulpbornne nie by magte was om die Hidrobreking Regulasies te promulgeer nie, dat dit teenstrydig was met die bepalings van die Nasionale Wet op Omgewingsbestuur en die Nasionale Waterwet en dat die promulgering van die regulasies prosedureel onregverdig was.&nbsp; Die Hof het hiermee saamgestem.&nbsp; Die Hof het ook ‘n kostebevel teen die Minister toegeken.</p>

<p>Die Hof het daarbenewens ook uitgevaar teen die Minister se promulgering van die Hidrobreking Regulasies wat eensydiglik die ooreenkoms met die Minister van Omgewingsake en die Minister van Waterwese gewysig het in terme waarvan die regulering van die omgewingsimpakte wat met mynwese gepaard gaan sedert September 2014 deur die Nasionale Wet op Omgewingsbestuur gereguleer word.</p>

<p>In sy kommentaar op die hofuitspraak het Douglas Stern die volgehoue verset van die Oos-Kaapse landbougemeenskap teen hidrouliese breking in die provinsie geprys.</p>

<p><strong>MEDIUM-TERM BUDGET: AGRI SA CONCERNED ABOUT REGULATION OF AGRICULTURAL LAND HOLDINGS BILL</strong></p>
<p><strong>&nbsp;</strong></p>
<p>Finance Minister Malusi Gigaba’s Medium-Term Budget Policy Statement (MTBPS) used several agricultural related metaphors, such as sowing and reaping. This highlights an emphasis on encouraging economic inclusiveness where citizens actively work together to build a better future for South Africa.</p>
<p>&nbsp;</p>
<p>Unfortunately, in the rest of his speech, agriculture received relatively little attention, besides mention of the potential economic link to the manufacturing sector. There was no mention of agriculture’s contribution to economic growth nor the plight of farmers affected by ongoing droughts. Worryingly, the contingency reserve has been pared down to a meagre R16 billion over the next three years. It is unclear how this will impact on emergency assistance for crises such as the drought and the recent outbreak of avian flu.&nbsp;</p>
<p>&nbsp;</p>
<p>Economic growth projections were revised downwards to 0,7% from the 1,3% tabled in February. Lower growth places further pressure on revenue collection and the government budget. For this reason, improving economic growth is a key theme throughout the MTBS. Unfortunately, South Africa’s current growth outlook compares poorly to that of the rest of Sub-Saharan Africa and our other key trading partners. While improving global growth presents an opportunity for increasing exports, domestic factors that dampen growth need to be addressed.</p>
<p>&nbsp;</p>
<p>Agri SA welcomes the Minister’s call for decisive leadership and the need for government to improve its productivity and decisiveness. We also welcome the focus on actions to combat constraints to economic growth. These constraints include policy uncertainty, governance challenges, a constrained fiscal framework and rising government debt, as well as political uncertainty.</p>
<p>&nbsp;</p>
<p>Minister Gigaba mentions several measures to boost confidence and support growth. However, Agri SA is concerned that the Regulation of Agricultural Land Holdings Bill is cited as one of these measures. Agri SA and other commercial lenders and industry stakeholders have been warning against this proposal for the past six years.&nbsp;</p>
<p>&nbsp;</p>
<p>The proposals from the Bill include restrictions on foreign ownership of farmland as well as the imposition of land ceilings in farm ownership.</p>
<p>&nbsp;</p>
<p>Land ceilings is a redistributive measure intended to limit the size of landholding to make more land available to subsistence, smallholder or emerging farmers. While such an approach may be well intended, it will not deliver the desired results and it will create far reaching negative consequences. These consequences will in the end hurt those the policy is intended to help. Imposing land ceilings will curb investment, productivity and the future growth of the sector that is responsible for national food security.</p>
<p>&nbsp;</p>
<p>Competing on the international stage requires economies of scale. Limiting the size of landholding has many practical complexities. For example, how will the allowable size of landholding be determined? Merely looking at a hectare metric will not suffice as different areas have different carrying capacities. How will large farming units, operating with economies of scale, be dismantled to operate on a much smaller (uncompetitive) scale? Such measures will have dire consequences for investor confidence, agriculture, the financial system and food security.</p>
<p>&nbsp;</p>
<p>Agri SA recommends a focus on policies that boost investor and consumer confidence and promote economic growth. Agri SA is concerned by the lack of clear implementation actions in the speech.</p>
<p>&nbsp;</p>
<p>From international experience, policies such as land ceilings have been proven flawed and cannot form part South Africa’s policy toolkit.</p>
<p>&nbsp;</p>
<p>Agri SA hopes that agriculture will receive greater attention in the 2018 budget.</p>

<p>Die tyd het lank reeds aangebreek dat die publiek en regering moet kennis neem van die wreedheid van plaasaanvalle, asook die aanslag op lede van die boerderygemeenskap en daarom ondersteun Agri SA die bewusmakingsveldtog&nbsp;<strong>Maandag, 30 Oktober 2017</strong>&nbsp;dat mede Suid-Afrikaners as blyk van meelewing swart klere sal dra.&nbsp;</p>

<p>Binne die Agri SA groep, speel die Agri Securitas Trustfonds ‘n belangrike rol om plaasgemeenskappe teen plaasaanvalle te help beveilig. In die praktyk voorsien die Trustfonds toerusting soos kommunikasienetwerke, kamera-stelsels, misdaadbekampingstoerusting en vele meer, aan die gemeenskappe. Die fonds is ook betrokke om traumaberading te verskaf, waar gemeenskappe dit benodig.</p>

<p>Die Trustfonds is maar een van die instrumente wat gebruik word om plaasgemeenskappe te beveilig en Agri SA sal voortgaan met sy beïnvloedingsrol om binne die regeringsopset oplossings vir plaasaanvalle te soek.&nbsp; Agri SA doen ‘n beroep op die Suid-Afrikaanse sakegemeenskap om die inisiatiewe van Agri SA te ondersteun en betrokke te raak by die groep.</p>

<p><strong>VIOLENCE AGAINST FARM COMMUNITIES MUST STOP</strong></p>

<p>South Africa cannot afford any further violence against farming communities. Farm attacks and the brutality thereof must be strongly condemned by all South Africans.</p>
<p>&nbsp;</p>
<p>“We think of the thousands of fellow South Africans who have lost their lives during the past year as a result of violent crime, 52 murders a day! Many farmers and farm workers count among those who have paid the highest price,” said Agri SA President Dan Kriek.</p>
<p>&nbsp;</p>
<p>34&nbsp;000 Farmers are suffering the effects of drought, natural disasters and policy uncertainty, while also trying to protect their lives and produce food for 55 million South Africans. One farmer feeds 1&nbsp;600 people a day. All these factors can in time give rise to food shortages, accompanied by instability in the country.</p>
<p>&nbsp;</p>
<p>It has long been time for the public and the government to take note of the brutality of farm attacks, as well as the onslaught aimed at members of the farming community. For this reason, Agri SA supports the awareness campaign that kicks off on&nbsp;<strong>Monday, 30 October 2017,</strong>&nbsp;with South Africans expressing their support by wearing black.</p>
<p>&nbsp;</p>
<p>“Farmers are vulnerable, and it is therefore important to be prepared at household level and, through community involvement, to curb this violent onslaught. One of the pillars for community participation in rural safety is the implementation of the Rural Safety Strategy. Becoming more proactive means that the individual and community must be ready and prepared for any event and this is only possible when farmers and farm workers are involved in the structures of organised agriculture,” said Kriek.</p>
<p>&nbsp;</p>
<p>Within the Agri SA group, the Agri Securitas Trust Fund plays an important role in safeguarding farmers. In practice, the Trust Fund makes equipment such as communication networks, camera systems, crime-fighting equipment, etc. available to communities. This fund is also involved in providing trauma counselling where communities require it.</p>
<p>&nbsp;</p>
<p>The Trust Fund is but one of the instruments used to protect farm communities and Agri SA will continue to play a lobbying role within government context to seek solutions in this regard. Agri SA also calls on the South African business community to support these initiatives and to become involved in the Agri SA group.</p>

<p>In closing, Kriek said: “I am fully aware of the emotional stress experienced within farming communities and that Agri SA and its provincial organisations will continue to seek solutions to stop the violent onslaught waged against our farming communities.”</p>

								<content:encoded><![CDATA[<p>&nbsp;<strong>Support rural safety in the festive season and beyond</strong></p>
<p>4 December 2017</p>
<p>&nbsp;All stakeholders in the agricultural sector must work together to combat the unacceptable level of crime farm communities are facing, especially during the festive season. On November 2, a group of concerned stakeholders came together in Pretoria to share ideas on how to tackle rural safety. During this meeting, the Agri Sector Unity Forum (Asuf) was tasked with forming an inclusive subcommittee to facilitate coordinated efforts between farming communities, service providers and other stakeholders to combat crime. Asuf is an inclusive, representative body comprising of Agri SA, the African Farmers’ Union (Afasa), the National African Farmers’ Union (Nafu) and the TAU SA.</p>
<p>&nbsp;Accordingly, Asuf recently held a meeting in Centurion to discuss the safety of all farmers, farm workers and rural communities.&nbsp; Japie Grobler, chairperson of Asuf, called on all farmers and farm workers to work closely with the police and their neighbours to bring an end to crime and to ensure a safe environment for everyone. Grobler also called on the public to financially support the Agri Securitas Trust Fund in their efforts to secure farming communities.</p>
<p>&nbsp;Farmer unions need cameras, drones, two-way radios and other technologies to help them to advance the safety of farming communities. Over the years,&nbsp;Agri Securitas has played a huge role in delivering a range of practical interventions to advance the safety of farmers and farm workers.</p>
<p>&nbsp;“Criminals pose a huge threat to food security and ultimately socio-economic stability,” says Grobler. “Extra precaution, high levels of vigilance and the establishment of collaborative networks at grass roots level between farmers and the police and amongst farmers are therefore of critical importance &#8211; especially during the festive period.”</p>
<p>&nbsp;Grobler commends the establishment of rural safety partnerships between various organised agricultural organisations in certain provinces and their efforts to stop crime and apprehend criminals. He welcomes the efforts by a wide array of stakeholders to bring about a safe rural environment within the ambit of the law.</p>
<p>&nbsp;Regardless of their farm output, ethnicity or gender, farmers and farm workers are continuously targeted by unscrupulous criminals. Criminals have no regard for the human and constitutional rights of farmers and their workers, their contribution to food security, job creation and the economic advancement of local communities.</p>
<p>&nbsp;The levels of crime on farms in South Africa are above international averages. The direct and indirect costs of crime to individuals, families, neighbourhoods, business, government and the economy pose a serious threat to food security and socio-economic stability. It causes a great financial loss, breakdown of trust relationships between local communities and instigates fear. Victims of crime also live with untold trauma and lasting physical and psychological scars.</p>
<p>&nbsp;The situation has become untenable. Criminals become more brazen by the day. Not only do they target and raid livestock, farm produce and infrastructure of commercial, emerging and subsistence farmers, but they are also brutalising and killing farmers, their family members and farm workers. In some instances, livestock is brutalised and maimed while still alive.</p>
<p>Asuf plans on arranging meetings with the Minister of Police and Cabinet in due course and will keep the public informed about the outcomes of these meetings and the actions that will follow.</p>

								<content:encoded><![CDATA[<p style="font-weight: 400;">On 5 December 2017, Health Minister Dr Aaron Motsoaledi announced that more than 30 people died following the recent outbreak of the food-borne disease listeriosis.</p>
<p style="font-weight: 400;">&nbsp;According to the National Centre for Communicable Diseases (NICD) approximately 557 cases have been reported, with the majority occurring in Gauteng province.</p>
<p style="font-weight: 400;">&nbsp;Listeria is a bacterium (<em>Listeria monocytogenes</em>) found in soil, water and vegetation. It can also occur in some animals, including poultry and cattle. Raw milk and other foods made from raw milk can also carry the bacteria.&nbsp; The disease cannot be spread through contact with infected people.</p>
<p style="font-weight: 400;">&nbsp;According to Janse Rabie, Head of Natural Resources at Agri SA, the recent outbreak of listeriosis emphasises the extreme vulnerability of all people when it comes to contamination of our natural resources, particularly soil and water.</p>
<p style="font-weight: 400;">&nbsp;According to the World Health Organisation (WHO), people should seek medical attention if they experience the following symptoms:</p>
<ul style="font-weight: 400;">
<li>Fever</li>
<li>A stiff neck</li>
<li>Confusion</li>
<li>General weakness</li>
<li>Vomiting (sometimes preceded by diarrhoea)</li>
</ul>
<p style="font-weight: 400;">&nbsp;The treatment of listeriosis is usually symptomatic and depends on the severity of the disease. If infection is severe, antibiotics may be recommended. People with a compromised immune system, older adults, infants or&nbsp;pregnant&nbsp;women may require urgent medical care.</p>
<p style="font-weight: 400;">&nbsp;Prevention measures include:</p>
<ul style="font-weight: 400;">
<li>Avoiding drinking unpasteurised milk or eating foods that contain raw milk</li>
<li>Practicing good hygiene, including washing hands regularly and make use of clean food preparation facilities</li>
<li>Thoroughly cooking animal foods such as meat, poultry or fish</li>
<li>Taking note of the expiry dates of perishable foods</li>
</ul>
<p style="font-weight: 400;">&nbsp;Agri SA is committed to providing any help it may have to offer in assisting the NICD or the Department of Health in isolating and eliminating the source of the disease.</p>

								<content:encoded><![CDATA[<p><strong>AgriSA: EXPERTS EXPECT FALL ARMYWORM MAY SPREAD THROUGHOUT SOUTH AFRICA</strong></p>
<p><strong>&nbsp;</strong>According to a recent media release, experts expect the fall armyworm (FAW) to spread across South Africa, with the possible exception of the Western Cape province. The report indicates that FAW infestations have been detected throughout Limpopo Province’s five districts, parts of Mpumalanga as well as the Eastern Cape.</p>
<p>The Department of Agriculture, Forestry and Fisheries (DAFF) has requested that farmers and agricultural organisations sharpen their monitoring and reporting efforts on the occurrence of this pest throughout the country.</p>
<p>Daily and weekly reports have to be submitted to DAFF for all new areas where FAW is found.</p>
<p>Agri SA welcomes the timeous actions being taken by DAFF, including its making pesticides available to combat the spread of this pest.&nbsp;Agri SA wishes to alert farmers that the application of chemicals must be carried out in consultation with chemical representatives.</p>
<p>Although this fall armyworm attacks mostly maize plants, it may occasionally attack cotton, wheat, sorghum, soybeans, potatoes and groundnuts.&nbsp; It is therefore also important to scout these crops for damage and the presence of the invasive species.</p>

<p>A well-known farmer, benefactor and community leader, Dirk Steenkamp, was murdered early Sunday morning on his farm in the Vredefort district. “Murders and other violent crime afflicting the farming community bear testimony to the serious shortcomings in people’s values and lack of respect for life,” said Agri SA president Dan Kriek.</p>
<p>Steenkamp was known in the community as a benefactor who never hesitated to help people in need. The murder once again highlighted the senselessness and cowardliness of such deeds, as well as the vulnerability of farmers and farm workers who perform their work outdoors in the interest of the country. The murder has enraged and caused immeasurable heartache to his family, farm workers and the community. Kriek, on behalf of Agri SA, expressed his condolences to the Steenkamp family and called on the police to arrest the attackers as soon as possible.</p>
<p>“The irresponsible and reckless utterances around the land issue that are regularly reported in the media lead to the polarisation of people and communities, and incite violence aimed at a certain group of society. These types of statements do not belong in a society where mutual respect and tolerance are essential for nation-building and stability,” said Kriek.</p>
<p>Kriek added that “unqualified statements on land are catastrophic for agricultural development and further investment in agriculture, especially since they are based on unfounded and incorrect assumptions. Such utterances could be interpreted by certain individuals as justification for attacking and murdering members of the farming community.”</p>
<p>“We believe there is still sufficient commitment within government to the principles of the Constitution to make sure that agriculture maintains its rightful place in the economy, to create jobs and to ensure that the sector can adhere to the principle of food security,” said Kriek.</p>
<p>Kriek called on agricultural communities to support their local security structures and to work with the police within community context to improve their own safety. However, no protection measure serves as a guarantee that a farm attack will not take place, but it could delay an attack and give residents a chance to take emergency measures.</p>

								<content:encoded><![CDATA[<p>Earlier today, DA leader Mmusi Maimane, announced at a press briefing that the predicted Day Zero scenario for the City of Cape Town may be avoided during the current year. The Day Zero scenario was used as a planning tool by the City of Cape Town as an indication as to when the City’s water supply was expected to fail because of the ongoing drought plaguing the City.</p>
<p>Day Zero was initially expected to arrive at 22 April but was shortly afterwards revised to 12 April. It was later pushed back to 16 April, then 11 May, 4 June, 9 July and has now been cancelled indefinitely. The City had prepared extensive contingency plans around the mobilisation of resources to supply citizens with 25 litres of potable water per person per day to be collected at certain designated locations throughout the City.</p>
<p>The City’s use of the Day Zero scenario had previously been questioned by various water-sector role players, including the agricultural sector. In many cases farmers have since 12 January 2018 had to make do with almost none of their allocated water because of Nationally-imposed and strictly-enforced water restrictions. This has lead of enormous losses and hardship for the agricultural community, including job losses for seasonal farm labourers.</p>
<p>While it clearly had the effect of focussing ordinary Capetonians’ attention on the severity of the prevailing drought, the use of the Day Zero scenario may also inadvertently have created its own unforeseen water management crisis. Panicked persons (who could afford to do so) began buying and stockpiling both raw and treated water in anticipation of Day Zero realising. This disruption of normal consumption patterns created enormous difficulties for City water planners as well as the Department of Water and Sanitation.</p>
<p>Although the City previously acknowledged that its estimations of its water supply were revised because of agriculture’s reduced consumption, it has failed to acknowledge agriculture’s concerted efforts in this regard or the disastrous effects of the drought on the agricultural sector. According to Agri SA’s Head of Natural Resources, Janse Rabie, the use (and now withdrawal) of the Day Zero scenario creates the impression the City may have cried wolf too soon and that the agricultural sector now has to pay for that action.</p>
<p>“While we are happy that Day Zero now appears to have been averted, people should realise that the current drought is by no means over. It remains a National Disaster which, particularly for the agricultural sector in the Western Cape, becomes worse with each passing day. We implore all spheres of government to maintain their focus on the severity of this drought and to step up the critical drought relief measures for the agricultural sector” said Rabie</p>
<p>While the imminent threat of Day Zero appears to have been averted, the prevailing drought in the Province and the City continues. Both the National Water Restrictions of 12 January 2018 as well as the City’s Level 6b Water Restrictions remain in place and citizens are implored to adhere to the requirement of, amongst other things, limiting their personal water consumption to no more than 50 litres per person per day.</p>

<p style="font-weight: 400;">This week the land debate that relates to expropriation without compensation was a focal point of the Grain SA congress.&nbsp; In true democratic style the floor was opened to accommodate a variety of views on the topic.&nbsp; “It was good to understand the hearts and minds of people and we welcomed a very constructive debate” Dan Kriek President of Agri SA mentioned.&nbsp;</p>
<p style="font-weight: 400;">From a farming perspective it is essential to protect the constitution and property rights.&nbsp; Grain SA managed to reach consensus on very important principles with the fundamentals of sustainability and food security being top of mind.&nbsp; “We will continue with this debate and will continue to understand and make constructive contributions as the example was set in Grain SA’s congress” Kriek remarked.&nbsp; &nbsp;&nbsp;&nbsp;</p>
<p style="font-weight: 400;">The final outcome was that Grain SA supported land reform in a sustainable manner to maintain economic growth and food security. The different groupings agreed that the dialog on land reform will continue whilst the current Constitution is upheld.</p>
<p style="font-weight: 400;">“In the end this is not just about farming and agriculture but the founding principles in our democracy that is at stake, we take these conversations very serious and we fully support Grain SA in their endeavors” Kriek said.</p>
